Competition Law Enforcement in Digital Markets in Poland and Germany

You are most welcome to join the Academic Society of Competition Law (ASCOLA) for an online event on competition law enforcement in digital markets, focusing particularly on Poland and Germany. ASCOLA is an international association of competition law scholars fostering research and dialogue worldwide. The German Chapter is based at our Faculty of Law.Competition law enforcement in digital markets in Europe, as well as in the US, Asia, and elsewhere, remains a key issue. The Commission's Digital Markets Act (DMA) enforcement is making progress, with several proceedings against gatekeepers ongoing. However, there is a threat of interference from trade policy negotiations coupled with protectionism. At the same time, there is disagreement over whether the DMA has met expectations thus far. The Commission has recently consulted stakeholders on their initial experiences with the DMA. Meanwhile, Member States are continuing to implement their own upgraded digital competition law provisions to tackle gatekeeper power across markets more effectively. These provisions (such as sec. 19a German Act against Restraints of Competition) also need to be evaluated in view of the track record so far and their relationship to the DMA.
